It was a most disturbing and quite very shocking news that had hit the airwaves some days back, when the news rented the air that one of the popular Nollywood Yoruba thespians Olanrewaju James Omiyinka but more popularly known by his nickname of Baba Ijesha, had been nabbed in the dastardly act as he supposedly defiled a minor, said to be just 14 year old. far worse. Meaning, he had flagrantly taken advantage of the trust bestowed on him over a 7 year period by the victim’s parents.

According to the gist, the teacher of the young girl had apparently noticed certain behaviour of the girl which prompted a suspicion that she’s already dating a boyfriend and reported same to the mother of the minor- Princess Adekola Adesanya. Then in order to ascertain her suspicion of molestation on the girl and confirm her apprehension, she planted a CCTV security camera in their home, which she could also view on her phone.

Then the Baba Ijesha dude obvious of what was in store, supposedly sneaked in, maybe like he normally does and took the 14 year old girl away from the sitting room where there was the camera to the kitchen where there was none, where he apparently took to devouring the young girl, unbeknownst to him and her, the security camera had picked up his supposed suspicious movements around the house, which had alerted the girl’s mom, who quickly ran home and supposedly met the quite unbelievable and unpalatable mess, that she couldn’t contain and has been inconsolable ever since! The 48 year old man was said to have immediately confessed to the dastardly atrocities, supposedly stating that the (sexual assault on the minor/victim) had been on going for 7 years, since the young girl was 7 years and she’s now 14! 7 straight years of defilement!

The actor whose career is now on the line over this crazy case was arrested and a case of defilement was filed against him at the Sabo Police Station by the aggrieved mother of the victim and the case was immediately transferred to the Gender Unit of the State CID, Panti, Yaba, Lagos for proper investigation.

The hardworking Lagos State Commissioner for Police, Mr. Hakeem Odumosu, had immediately ordered for a full investigation into the case, while in the same vein promising that justice would be done in the matter, no matter what.

As it is now, if the (supposed assailant) is convicted by a court of competent jurisdiction on the case of repeated (defilement) of a minor for 7 years running, the actor, who is old enough to be the father of his victim, actually risks a life imprisonment penalty.

What is defilement law?

It is any sexual intercourse with a child under the age of 18 years old, whether or not the child consents.

Defilement is not a bailable offence.

It is even expressly stated in the section that whoever is found guilty is liable for felony, a grave offence which ought – by nature of its gravity – non-bailable. With or without canning; defilement attracts a punishment of 14 years of incarceration.

According to the sexual offences act- section 218 of the criminal code act.

(1) A person who commits an act which causes penetration with a child is guilty of an offence termed defilement. (2) A person who commits an
offence of defilement with a child aged eleven years or less shall upon conviction be sentenced to imprisonment for life.

It must be noted very well though that, prosecution of a case of the act of defilement must commence within 2 months of the act committed, or else no prosecution can occur again afterwards.

The above actually means that the defence lawyers, whoever they might be already have their case cut out for them. They must prove the innocence of their client beyond all reasonable doubts for the thespian to escape conviction. Minimum penalty is 14 years and maximum penalty is life imprisonment.

We tried reaching out to Baba Ijesha to at least get his own side (version) of the story, but he didn’t respond to our WhatsApp messages/enquiries, maybe because he had already been incarcerated without access to his phone.
